Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FencesHOA (“Fences,” “we,” “us”), a software service for homeowners’ association boards, operated as a sole proprietorship based in Indiana, USA. By creating an account or otherwise using FencesHOA, you agree to these Terms. If you’re using FencesHOA on behalf of an HOA or other organization, you’re confirming you’re authorized to act for that organization, and “you” includes that organization.

FencesHOA provides a web application for managing an HOA’s home and owner directory, and optional integrations with third-party services such as Google and QuickBooks Online. FencesHOA is a management tool, not a substitute for professional legal, tax, or accounting advice for your HOA.

You’re responsible for the accuracy of the information you provide and for safeguarding your account credentials. You’re responsible for activity that occurs under your account. Let us know right away at privacy@fenceshoa.com if you suspect unauthorized use of your account.

Any fees for paid plans will be disclosed to you at signup or in a separate order form before you’re charged. Payments are processed by our payment processor, Stripe, and are subject to Stripe’s terms; we don’t receive or store your full card number. FencesHOA is currently in early access and may be offered free of charge or under introductory terms that are subject to change with notice.

You agree not to:

• Use FencesHOA for any unlawful purpose, or in violation of any applicable law;
• Attempt to access another organization’s data or account without authorization;
• Reverse engineer, decompile, or attempt to derive the source code of the service;
• Interfere with or disrupt the integrity or performance of the service;
• Upload content you don’t have the right to share.

You retain ownership of the HOA and homeowner information you or your board enters into FencesHOA (“your data”). You grant us a license to host, process, and display your data solely to provide the service to you. You’re responsible for having the right to enter homeowner information into FencesHOA and for your own compliance with any privacy obligations you owe to your residents. FencesHOA integrates with third-party services, including Google and, optionally, QuickBooks Online. Connecting these services is subject to that provider’s own terms and privacy policy, and we’re not responsible for their availability, accuracy, or changes to their services.

FencesHOA and its branding, software, and content are owned by us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use FencesHOA for your organization’s internal HOA management purposes — nothing more.

FencesHOA is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the service will be uninterrupted or error-free.

To the fullest extent permitted by law, FencesHOA won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the service. Our total liability for any claim arising from these Terms or the service is limited to the amount you paid us, if any, in the twelve months before the claim arose.

You may stop using FencesHOA and close your account at any time. We may suspend or terminate access if you violate these Terms. On termination, we’ll provide a reasonable window to export your data before it’s deleted from our systems, except where we’re required to retain it longer by law.

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws principles, and any dispute will be resolved in the state or federal courts located in Indiana.

We may update these Terms from time to time. We’ll update the effective date above, and for material changes we’ll make reasonable efforts to notify account holders.
